MONSON ZONING BOARD OF APPEALS
MINUTES SEPTEMBER 24, 2015

MEMBERS PRESENT: David Jarvis, Frank Carey, Ronald Fussell, Tere Hrynkiw, Theresa Martin and David Beaudoin.

7:30  Frank Carey moved to accept the minutes of August 27, 2015 as presented.

Ronald Fussell seconded the motion.

It was so voted, unanimous.

David Beaudoin recused himself to avoid the appearance of a conflict.

David Jarvis reconvened a public hearing for William & Lucinda Nothe for a variance to construct a three season room to the rear of existing home that did not meet the rear setback of fifty (50) feet.

At the last meeting the Board asked for a revised plan showing the distance from the overhang of the proposed construction to the rear property line.

The applicants submitted a revised plan that showed a setback that included an overhang on the proposed addition of thirty four (34) feet from the rear property line.

David Jarvis questioned if the revised plan satisfied the questions that the Board members had regarding the setbacks?

It was the consensus of the Board that the plan clarified the setbacks.

Frank Carey moved to grant variance from the requirements of Section 3.1 Town of Monson Dimensional & Density Regulations (Table 2) of the Monson Zoning Bylaws with conditions:

  • The construction shall be in strict conformance with the plan submitted prepared by Donald J. Frydryk, P.E. Sherman & Frydryk, LLC, Land Surveying & Engineering dated June 26, 2015 revised September 14, 2015.
  • All other setbacks shall conform to the Monson Zoning Bylaw requirements.
  • The Variance shall not take effect until the decision is recorded in the Hampden County Registry of Deeds.
The Board found that the proposed construction was located in such a manner as to cause the least amount of alteration to the existing structure.  The relief sought would not be detrimental to the public good and the construction was in harmony with the surrounding neighborhood.

Tere Hrynkiw seconded the motion.

It was so voted, unanimous.

David Beaudoin returned.

8:15 P.M. Frank Carey moved to adjourn.

David Jarvis seconded the motion.

It was so voted, unanimous.
